1. Acceptance of Terms

By accessing or purchasing "The Brainy Pom" digital product (the "Product"), you agree to be bound by these Terms and Conditions ("T&Cs").

2. Digital Product Purchase and Delivery

  • Product: The Product is a digital download (e.g., a PDF, eBook, or video series). No physical product will be shipped.

  • Delivery: Upon successful payment, a download link will be provided immediately on the thank-you page and sent to the email address provided at the time of purchase.

  • Disclaimer on Results: The effectiveness of the Product depends on your consistent effort and the specific circumstances of your dog. We make no guarantee of specific results, as results will vary widely.

3. Licensing and Intellectual Property

  • License Grant: When you purchase the Product, you are granted a single-user, non-transferable, personal license to use the content for your own dog training purposes.

  • Restrictions: You may not share, resell, reproduce, redistribute, or use the Product or any of its content for commercial purposes without the express written permission of Brainy Pom. All content, including text, graphics, and structure, is the intellectual property of Brainy Pom.

4. Payment and Refund Policy

  • Payment: All prices are as stated on the website. Payment must be made in full at the time of purchase.

  • Our 30-Day Result Guarantee: Because "The Brainy Pom" is a digital product delivered instantly, we do not offer unconditional refunds. However, we stand behind the effectiveness of our training. To be eligible for a refund, you must:

    1. Complete the full 30-day training challenge as outlined in the Product.

    2. Provide proof of completion (e.g., completed worksheets/logs) if requested.

    3. Submit your request within 35 days of purchase.

  • All Other Sales Final: Outside of this specific Performance-Based Guarantee, all sales are final and non-refundable. Accessing the download link or viewing the content constitutes a waiver of any standard "cooling-off" period.

  • Technical Issues: Refunds will be issued if the digital file is proven to be corrupted and a functional replacement cannot be provided within 72 hours.

5. Limitation of Liability

In no event shall Brainy Pom or its affiliates be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the Product, including, but not limited to, damages for loss of profits, goodwill, data, or other intangible losses.
